The court has ruled that Google's actions of providing benefits to game companies to discourage them from releasing games on One Store were unlawful. However, it decided that the 42.1 billion won fine must be recalculated.

On November 3, the 3rd Administrative Division of the Seoul High Court delivered a partial victory to the plaintiffs in a lawsuit filed by Google LLC, Google Korea, and Google Asia Pacific against the Korea Fair Trade Commission to cancel corrective orders and the imposition of fines.

In 2023, the Korea Fair Trade Commission deemed it an unfair practice that Google provided Google Play featuring and marketing support under the condition that games not be released on One Store from June 2016 to April 2018, resulting in a 42.1 billion won fine. Google appealed the decision by filing a cancellation lawsuit.

The court ruled that Google's aforementioned behavior was indeed illegal. Specifically, considering Google's influence within the app market, the fact that game companies heavily prioritize featuring to increase exposure, and how Google strategically utilized this, the court concluded that Google induced game companies to favor Google Play.

However, the court noted that while the imposition rate of 2.3% used by the Korea Fair Trade Commission in calculating the fine was appropriate, the applied period and scope were overly broad. Since the court cannot directly calculate the precise amount, the Korea Fair Trade Commission will recalculate the fine later, taking the ruling's details into account.

Regarding this court decision, an official from One Store stated, "We welcome the court's judgment that Google's actions of excluding One Store from the market were illegal, and the imposition and recalculation of the fine are matters for the relevant authorities to decide in accordance with the spirit of the ruling." The official added, "Based on the illegality confirmed in this verdict, One Store plans to actively pursue civil litigation. We expect appropriate accountability and sanctions corresponding to Google's actions, and hope this serves as an opportunity to establish a fair competitive order in the app market in South Korea."
