Nintendo has filed a lawsuit against the U.S. government seeking a refund on tariffs, based on a Supreme Court ruling that declared the Trump administration's tariff measures unconstitutional. Nintendo’s position is that it is entitled to a full refund of the tariffs paid, along with accrued interest, arguing that the administration's levies lacked a legal basis.

Nintendo of America filed the complaint with the U.S. Court of International Trade on the 6th (local time). The lawsuit names several key government departments, including the Treasury, Homeland Security, and Commerce, as well as high-ranking current and former officials such as Treasury Secretary Scott Bessent and Commerce Secretary Howard Lutnick. Nintendo’s legal team contends that the Trump administration abused the International Emergency Economic Powers Act (IEEPA) to implement unjustified tariffs, causing the company significant financial losses.

In particular, Nintendo launched its next-generation console, the Nintendo Switch 2, last year, but was forced to postpone pre-orders in the U.S. due to the administration's retaliatory tariffs. While Nintendo maintained the console's base price, it had to increase the cost of peripherals and navigate complex management pressures, such as shifting production bases from China to Vietnam to avoid tariffs. With hundreds of other companies, including Costco and FedEx, pursuing similar litigation, the scale of potential tariff refunds is expected to grow significantly.

Meanwhile, President Trump has not backed down from his tariff policy following the Supreme Court's ruling. Immediately after the decision, the President invoked provisions of the Trade Act of 1974 to introduce new tariffs. This move is seen as an attempt to force through his trade policy by utilizing previously unused legal provisions after the initial measures were blocked by the judiciary.

Although the court has ordered the government to provide prompt refunds, U.S. Customs authorities stated that it would take approximately 45 days to establish a refund system. With the administration continuing its retaliatory taxation, the legal dispute is expected to be prolonged.
